Intellectual Property & Copyright Policy

All content created, sold, or displayed by Prosperous Visionary Designs (“PVD”) is protected under United States Copyright Law and international copyright treaties. Unauthorized use of PVD content is strictly prohibited.

 

 

1. Ownership of Intellectual Property

Unless otherwise stated:

PVD retains full copyright and ownership of all:

  • Digital designs (PNG, SVG, JPG, PDF, PSD, etc.)
  • Canva templates
  • Mockups
  • Branding systems
  • Logos created by PVD
  • Website banners and layouts
  • Social media templates
  • Photography and stock images
  • AI-generated graphics
  • Custom design work (unless copyright is transferred in writing)
  • All content displayed on our website

Purchasing a product does not transfer ownership — it grants you a license to use the product (see Digital License & Usage Rights Policy).

 

 

2. Prohibited Uses

Customers may NOT, under any circumstances:

✘ Resell or redistribute digital files
 ✘ Give away PVD files for free
 ✘ Upload PVD files to any marketplace (Etsy, Creative Fabrica, Freepik, etc.)
 ✘ Claim PVD artwork or templates as your own
 ✘ Upload files to print-on-demand platforms like Amazon Merch, Teespring, Redbubble, unless permitted by extended license
 ✘ Use digital files to create new templates for resale
 ✘ Convert designs into SVGs or other formats for resale
 ✘ Use PVD content to train AI or feed into AI software
 ✘ Modify PVD designs and resell them as new designs
 ✘ Reproduce PVD website content without permission

Copyright violations may result in:

  • DMCA takedowns
  • Account suspension (Etsy, Shopify, TikTok, Meta, etc.)
  • Legal action
  • Permanent ban from purchasing PVD products

 

 

3. Custom Designs — Copyright Clarification

For custom branding, banners, and design services:

  • PVD retains copyright ownership unless a copyright transfer agreement or buyout is purchased.
  • Customers receive usage rights appropriate to their project (branding use is allowed; reselling files is not).

If a customer wants full rights to a custom design (ownership of the source files), this must be purchased separately.

 

 

4. Trademarks & Branding

The following are protected trademarks and may not be copied, used, or reproduced:

  • Prosperous Visionary Designs
  • The PVD logo(s)
  • Product taglines
  • Signature design styles and layouts

You may not use our trademarks without written permission.

 

 

5. Reporting Copyright Violations

If you believe any PVD content is being used without permission, please report it immediately.

  • Link to the infringement
  • Screenshot(s)
  • Order number (if applicable)

PVD actively issues DMCA notices on:

  • Etsy
  • Shopify
  • Facebook
  • Instagram
  • TikTok
  • Pinterest
  • Hosting providers
  • Marketplaces
  • Google Search

We take copyright theft seriously.

 

 

6. DMCA Takedown Policy

PVD complies with the Digital Millennium Copyright Act (DMCA).

We may:

  • File takedowns against infringing sellers
  • Request removal of stolen content
  • Provide proof of ownership
  • Ban individuals from future purchases

If someone believes PVD infringed their rights, they may also submit a DMCA complaint to us, which we will evaluate.

 

 

7. User-Submitted Content

When you submit content (names, text, photos, artwork) for custom orders:

  • You confirm you own or have rights to the materials
  • You agree PVD is not liable for copyright issues arising from your provided content
  • You grant PVD permission to use the content strictly for completing your order

You may NOT provide copyrighted images (e.g., Disney, Nike, celebrities) unless you have proper rights.

 

 

8. Violations & Enforcement

If a violation is found, PVD may:

  • Terminate your license
  • Block future purchases
  • File DMCA claims
  • Pursue legal action
  • Demand removal of infringing products
  • Require payment for damages

No refunds will be issued to users banned for copyright abuse.

 

 

9. Educational Use

PVD content may NOT be used in:

  • Courses
  • Workshops
  • Tutorials
  • E-books
  • Classes
  • Digital training materials

…unless a separate extended education license is purchased.
